Recreational cannabis in New Zealand

Recreational cannabis remains illegal throughout New Zealand. Possession, cultivation and supply are separate offences, while the law directs police to consider whether prosecution for personal possession or use is in the public interest.

The national starting point

Cannabis is controlled under the Misuse of Drugs Act 1975. Recreational possession, cultivation and supply have not been legalised.

The public-interest direction

For personal possession and use, the Act requires consideration of whether a health-centred approach would be more beneficial and whether prosecution is required in the public interest. This does not repeal the offence.

Cultivation remains distinct

There is no lawful recreational home-grow amount. Cultivation, supply, import and drug driving each have their own legal tests and consequences.
